In the state of Illinois, your right to generate solar energy is legally protected. Under the Illinois Homeowners' Energy Policy Statement Act (765 ILCS 165/), a homeowners association or condo board cannot enact bylaws, deed restrictions, or covenants that explicitly prohibit the installation of a solar energy system.
While an HOA cannot outright ban solar panels, they are allowed to implement "reasonable restrictions." For example, they may require you to submit an architectural review application, or ask that the panels be mounted flush to the roof. However, if the HOA's aesthetic demands decrease the system's energy production or increase the installation cost significantly, those demands are legally unenforceable.
