In the state of Colorado, your right to generate solar energy is fiercely protected. Under Colorado Revised Statutes (C.R.S.) § 38-30-168, a homeowners association cannot enact or enforce bylaws, deed restrictions, or covenants that explicitly prohibit the installation of a solar energy system.
While a Denver HOA cannot outright ban solar panels, they are allowed to implement "reasonable aesthetic restrictions." For example, they may ask that the panels be mounted flush to the roof or that wiring be hidden. However, if the HOA's aesthetic demands decrease the system's energy production by more than 10% or significantly increase the installation cost, those demands are legally unenforceable.
